Eligibility: To enter the Obviously Instagram Sample Giveaway (the “Giveaway”), you must be at least 18 years of age and a legal resident of the contiguous United States. Employees, officers and directors of Obviously Social LLC (“Sponsor” and “Administrator”), or their parent, subsidiaries, or affiliates, and anyone involved in the production or administration of the Giveaway, and any member of the immediate family or household of any such persons, are not eligible. Giveaway is void where prohibited. The Giveaway is subject to all applicable laws and regulations. WINNER SELECTION, NOTIFICIATION AND ODDS OF WINNING: Samples will be awarded on a first come, first served basis. Limit one (1) sample per person. ARV of each sample is USD $1.00. Samples are provided "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). If you receive a sample, you may not transfer, assign, or redeem the sample for cash. Federal, state, and local taxes on ARV of the samples, if any, and any other costs, fees and expenses are the sole responsibility of winner.
Release of Liability: By entering the Giveaway, entrant agrees to hold Sponsor, Administrator, and their parents, affiliates and subsidiary companies, and each of their respective directors, officers, employees and assigns (collectively, the “Released Parties”) harmless for any injury or damage caused or claimed to be caused, in whole or in part, directly or indirectly, by participating in the Giveaway or by acceptance or use of a sample. Governing Law and Venue: Except where prohibited by law, all issues concerning the construction, validity and enforcement of these Rules, or the rights and obligations of the entrant and Sponsor, shall be constructed and governed by the laws of the state of New York, without regard to conflicts of law. Claims may not be resolved through any form of class action. Exclusive jurisdiction and venue for all suits will be in the Southern District of New York or, if there's no federal jurisdiction, New York City.
Privacy: Any information you submit is subject to Obviously's privacy policy posted at https://studio.obvious.ly/privacy. Additionally, you grant Sponsor and Administrator the right to contact you for marketing and transactional purposes using the information that you provide. You may unsubscribe or revoke this consent at any time.
Severability: If any provision(s) of these Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
